Terms of Service

These terms govern purchases made through this online store, operated by Oliwier Rucinski, sole trader (OSVČ), trading as ELVARNIXO, Bulharská 14, 360 01 Karlovy Vary, Czech Republic.

1. Scope

These terms apply to all orders placed through this store. Deviating terms of the customer do not apply unless we agree to them in writing.

2. Formation of the contract

Product listings are an invitation to order and not a binding offer. By placing an order you make a binding offer to purchase. The contract is concluded when we confirm your order by email. Before submitting the order you can review and correct all entries on the checkout page; the order button is marked as creating an obligation to pay. We store the contract text and send you an order confirmation by email. The contract is concluded in English.

3. Prices and payment

All prices are stated in Czech koruna (CZK) and are final prices for consumers. Shipping costs are shown separately at checkout before you place your order and are set out in our Shipping and Delivery policy. Payment is made using the methods displayed at checkout.

4. Delivery and passing of risk

Delivery times and costs are set out in our Shipping and Delivery policy. For consumers, the risk of damage to the goods passes on delivery to you, not on hand-over to the carrier.

5. Retention of title

The goods remain our property until payment has been received in full.

6. Right of withdrawal

Consumers have a 14-day right of withdrawal as described in our Returns and Refunds policy, which also contains the model withdrawal form.

7. Rights from defective performance

Statutory rights from defective performance apply under the Czech Civil Code, including the 24-month period for consumer goods. Nothing in these terms limits or excludes your statutory rights. Where a manufacturer offers an additional guarantee, its terms are supplied with the goods.

8. Safe use of studio equipment

Studio flash units store a lethal charge in their capacitors even when unplugged — never open the housing; there are no user-serviceable parts inside. Use mains equipment on earthed outlets only, indoors and dry unless an IP rating states otherwise. Modelling lamps and LED fixtures run hot: let them cool before changing modifiers, and use only modifiers rated for the fixture's output. Weight stands and booms with the recommended counterweights and sandbags, and never exceed the stated load of a stand, boom or ceiling rail. Charge lithium batteries only with the supplied charger and stop using any battery that is swollen, hot or damaged.

9. Compatibility

Specifications — mounts, power, output and trigger systems — are stated as supplied by the manufacturer. Please check that modifiers, mounts and radio triggers are compatible with your existing equipment before ordering; if you are unsure, ask us and we will confirm what a product fits.

10. Liability

We are liable without limitation for damage arising from injury to life, body or health, and for intent and gross negligence. In cases of slight negligence we are liable only for breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

11. Applicable law and disputes

Czech law applies. For consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The competent body for out-of-court settlement of consumer disputes is the Czech Trade Inspection Authority (www.coi.cz).
